    Terms of Service

    Effective April 23, 2026 · Version 1.0

These Terms of Service ("Terms") govern your access to and use of the Crimsie platform and services ("Service"), operated by Crimsie ("we," "us," or "our"). Please read them carefully. By creating an account or using the Service, you agree to these Terms.

    1.Acceptance of Terms

By accessing or using the Service (including by creating an account, uploading content, placing an order, or simply browsing), you confirm that you are at least 16 years of age, have the legal capacity to enter into a binding agreement, and agree to be bound by these Terms and our Privacy Policy.

If you are using the Service on behalf of a business or organisation, you represent that you have authority to bind that entity to these Terms, and references to "you" include that entity.

If you do not agree, please do not use the Service.

    2.The Service

Crimsie provides a cloud-based photo book creation platform that allows you to design, customise, and order professionally printed photo books and related products ("Products"). The Service includes web-based design tools, AI-assisted features, cloud storage for your designs and uploaded content, and access to printing and fulfilment capabilities.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We will not be liable for any modification, suspension, or discontinuation.

    3.Accounts & Registration

To access most features, you must create an account using a valid email address or a supported third-party authentication provider. You agree to provide accurate, current, and complete information and to keep your account credentials confidential.

You are responsible for all activity that occurs under your account. Notify us immediately at hello@crimsie.com if you suspect unauthorised access.

We may suspend or terminate accounts that we believe have been used fraudulently, abusively, or in violation of these Terms, or that have been inactive for an extended period following reasonable notice.

    4.Image Quality & Your Responsibility

We flag photos that may not contain enough detail for their printed size. If you see a warning, make the photo smaller on the page or replace it with the full-size file from your phone or camera. Automated checks cannot detect every blurry, compressed, or out-of-focus photo, so review every page and crop before ordering.

4.1 Your responsibility for image quality

You are solely responsible for the quality, resolution, and suitability of all images, photographs, and other visual content you upload to the Service. Crimsie processes and prints content as you have designed it and cannot be held responsible for print or digital output quality that results from the nature of your source material.

    4.2 Automated quality warnings

The Service may issue warnings for images that appear to fall below a print-quality threshold (typically below approximately 160 DPI at their intended print dimensions). These warnings are advisory only. Automated resolution checks cannot reliably detect or flag:

    • Images that are blurry, soft-focus, or out-of-focus
    • Compression artifacts and JPEG degradation
    • Grain, noise, or film artefacts
    • Motion blur or camera shake
    • Poor exposure, lighting, or colour balance
    • Screenshots, screen recordings, or low-resolution digital exports
    • Digitised scans of low-quality originals
    • Poor cropping or unflattering composition choices
    • Images that are visually unsuitable for large-format or print use

The absence of a quality warning is not a guarantee that an image will print satisfactorily. The final assessment and responsibility rest with you.

    4.3 Pre-order review obligation

Before placing any order, you are responsible for thoroughly reviewing your complete design in the on-screen preview, including all images, their placement and cropping, text and personalised content, page layouts, and the overall design. Proceeding to checkout and confirming an order constitutes your acknowledgement that you have reviewed the design and that it meets your requirements.

4.4 Orders placed: non-refundable quality matters

Once a print order has been accepted and sent to production, we are unable to issue refunds or replacements for dissatisfaction arising from matters within your control, including but not limited to:

    • Image quality arising from the source material you uploaded
    • Layout, composition, or design choices you made or approved
    • Text, names, dates, captions, or other content you entered
    • Cropping or positioning visible in the pre-order preview
    • Colour rendering differences between screen and print (monitor calibration varies)
    • Design oversights that were visible and reviewable before order submission

If we identify a production error or manufacturing defect on our part, we will work with you to remedy it. Please contact us within 14 days of receiving your order.

Tip: Download your design as a PDF preview before ordering. This lets you review the layout at full size on any device or print it for a rough physical check.

    5.Your Content & Intellectual Property

    5.1 Ownership

You retain all rights, title, and interest in and to the photographs, images, text, and designs you upload or create using the Service ("User Content"). These Terms do not transfer ownership of your content to us.

    5.2 Licence to us

By uploading or creating User Content, you grant us a limited, non-exclusive, royalty-free, worldwide licence to store, process, display, reproduce, and transmit your content solely to the extent necessary to provide and improve the Service, fulfil your orders, and operate the platform. This licence terminates when you delete the content or close your account, subject to reasonable retention periods required for legal and operational purposes.

    5.3 Your warranties

You represent and warrant that: (a) you own or have all necessary rights to the content you upload; (b) your content does not infringe any third party's intellectual property, privacy, or other rights; (c) you have obtained any necessary consents from individuals depicted in your photographs; and (d) your content does not violate any applicable law.

    5.4 Our intellectual property

All software, templates, design tools, layouts, illustrations, graphics, text, and other materials we provide through the Service are and remain our property or the property of our licensors. You may not copy, modify, reverse engineer, or otherwise exploit our intellectual property except as expressly permitted.

    6.AI-Assisted Features

Some features of the Service use artificial intelligence and machine learning systems. These systems process your uploaded content to provide functionality. AI outputs are suggestions only, so always review them before use.

6.1 What AI features we use

The Service incorporates AI-assisted functionality, which may include: automated photo curation and arrangement suggestions; AI-generated cover illustrations and artwork; smart layout recommendations; and image analysis for quality guidance. These features are powered by third-party AI providers (see Section 8) and operate server-side.

6.2 Processing of your content by AI systems

When you use AI-assisted features, your uploaded images, design data, and related metadata may be transmitted to and processed by AI service providers for the purpose of generating recommendations, arrangements, or artwork. We select providers with data processing agreements that limit secondary use. AI providers are prohibited from using your content to train their models beyond what is necessary to deliver the requested functionality, subject to their own terms.

If you prefer not to use AI features, you may create and customise your book entirely manually. All AI-assisted actions are optional and clearly labelled within the interface.

6.3 AI output limitations and your review obligation

AI-generated suggestions, arrangements, and artwork are provided as creative assistance. They are not guaranteed to be accurate, contextually appropriate, artistically optimal, or free from errors. You are solely responsible for reviewing and approving all AI-generated content before including it in your final design or placing an order. We disclaim all liability for outcomes arising from AI-generated suggestions that you have approved and included in an order.

6.4 No automated decision-making with legal effect

AI features within the Service are creative and organisational tools only. No AI feature is used to make decisions that produce legal effects or similarly significant effects on you.

    7.Orders, Printing & Fulfilment

When you place an order, you are making an offer to purchase Products at the price shown, which we may accept or decline. Order confirmation by us constitutes acceptance of your offer and the formation of a binding contract.

All prices are shown inclusive of applicable taxes unless otherwise stated. Prices may vary by product size, specification, and delivery region. Shipping costs are shown at checkout.

We reserve the right to cancel orders that we reasonably believe contain content that violates these Terms, is unlawful, or presents production challenges we cannot fulfil. If we cancel an order, we will provide a full refund of any amount charged.

Estimated production and delivery times are indicative only and are not guarantees. We are not responsible for delays caused by third-party logistics providers or circumstances beyond our control.

    8.Third-Party Services

    8.1 Subprocessors and integrations

The Service is built on and integrated with third-party services and infrastructure providers. These may include, without limitation: cloud infrastructure and database providers; AI and machine learning service providers; payment processors and financial services; email and transactional communication providers; analytics and performance monitoring services; authentication and identity providers; customer support platforms; and print production and fulfilment partners.

    8.2 Third-party terms

Your use of the Service may be subject to the terms and privacy policies of these third-party providers where their services handle your data. We maintain data processing agreements with subprocessors and require them to protect your data in accordance with applicable law. A current list of subprocessors is available on request.

8.3 Service availability and third-party dependencies

Certain features of the Service depend on third-party infrastructure. We do not guarantee uninterrupted availability and are not liable for service degradation, outages, or data loss caused by third-party providers, provided we take reasonable steps to mitigate such risks. We will notify users of significant planned downtime where practicable.

    8.4 Payment processing

Payment card details are processed by a PCI-DSS compliant payment processor and are never stored on our servers. By placing an order, you also agree to the payment processor's applicable terms of service.

    9.Acceptable Use

You agree not to use the Service to:

    • Upload, create, or order content that is unlawful, obscene, defamatory, harassing, or that infringes any third party's rights
    • Upload images of individuals without their consent, including minors in a sexualised or inappropriate context
    • Violate any applicable laws, including those relating to privacy, data protection, intellectual property, or export controls
    • Attempt to circumvent security measures, scrape the platform, or interfere with its operation
    • Use the Service for any commercial resale purpose without our prior written consent
    • Misrepresent your identity or the ownership of content you upload

We reserve the right to remove content, suspend accounts, and report illegal activity to relevant authorities in our sole discretion.

    10.Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy describes how we collect, use, store, and share your personal data, including data processed in connection with AI features and third-party integrations.

    11.Disclaimers & Warranties

The Service is provided on an "as is" and "as available" basis to the fullest extent permitted by applicable law. We make no representations or warranties of any kind, express or implied, regarding the Service's reliability, accuracy, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that defects will be corrected. AI-assisted features are provided without warranty as to their accuracy, artistic quality, or fitness for any purpose.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable consumer protection law.

    12.Limitation of Liability

To the fullest extent permitted by law, Crimsie and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Service.

Our total aggregate liability to you for any claim arising under or in connection with these Terms shall not exceed the greater of: (a) the amounts you have paid to us in the three months preceding the event giving rise to the claim; or (b) fifty US dollars (USD 50).

These limitations apply regardless of the form of action, whether in contract, tort (including negligence), or otherwise, and whether or not we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability. In those jurisdictions, our liability is limited to the maximum extent permitted by applicable law.

    13.Indemnification

You agree to defend, indemnify, and hold harmless Crimsie and its affiliates, officers, and employees from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your infringement of any third-party rights.

    14.Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms with a new effective date and, where reasonably practicable, by sending you an email or displaying a notice within the Service. Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of those changes.

We maintain a version history. The current version of these Terms is 1.0, effective April 23, 2026.

    15.Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of Pakistan, without regard to its conflict of law provisions.

We encourage you to contact us first to resolve any dispute informally. If a dispute cannot be resolved informally, it shall be submitted to the jurisdiction of the courts of Pakistan, subject to any mandatory consumer-protection rights you have in your country of residence.

If you are a consumer in the European Union, you may also have the right to bring a claim before the courts of your country of residence and access online dispute resolution through the EU ODR platform.
